Terms of Service

1. Who you are contracting with

These Terms govern your use of online coaching, training programmes, nutrition guidance and related services (the "Service") provided by LMperformance ("we", "us", "our"). By creating an account or purchasing a plan, you agree to these Terms.

2. The Service

We provide personalised, 100% online fitness coaching. All services — including training programmes, nutrition guidance, weekly check-ins, messaging support and progress tracking — are delivered digitally through our web app and online client portal. There are no in-person sessions, gym access, physical products or shipping involved.

3. Eligibility & accuracy

You confirm you are at least 18 years old (or have parental consent) and physically able to undertake exercise. You agree to provide accurate information about your health, training history and goals, and to tell us if any of this changes. Our coaching is not a substitute for medical advice — consult a qualified professional before starting any new exercise or nutrition programme.

4. Acceptance & responsible use

You agree not to:

  • use the Service for unlawful purposes, fraud or spam;
  • infringe our intellectual property or that of any third party;
  • share, resell, or redistribute coaching materials, plans or messages;
  • attempt to interfere with the security or integrity of the Service.

5. Intellectual property

All training plans, written content, video material, branding and other materials provided through the Service remain the property of LMperformance. You receive a personal, non-exclusive, non-transferable licence to use them for your own training while your plan is active.

6. Payments & billing

Payments are processed securely by Stripe. By purchasing a plan you authorise LMperformance to charge your chosen payment method through Stripe for the applicable fees.

Monthly coaching plans renew automatically each month and carry a 3-month minimum commitment from your first payment. The 12-Week Transformation is a single one-off payment with no auto-renewal.

7. Cancellations

You can cancel a recurring plan at any time after the 3-month minimum commitment via your account page or the Stripe billing portal. Cancellation takes effect at the end of your current paid billing period, and you retain full access until that date. After access ends, your coaching materials may be archived in line with our Privacy Notice.

8. Refunds

Refunds are governed by our Refund Policy. We offer a 14-day money-back guarantee from your first payment. Because coaching is digital and personalised, refund requests after 14 days are reviewed on a case-by-case basis.

9. Service performance

We work to provide the Service with reasonable skill and care, but we do not guarantee uninterrupted or error-free operation, or any specific physical result. Outcomes depend on your effort, consistency, adherence and individual circumstances.

10. Suspension & termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud concerns, abusive behaviour toward the coach or other clients, or repeated policy violations.

11. Liability

To the fullest extent permitted by law, our total aggregate liability to you in connection with the Service is limited to the fees you paid us in the preceding 6 months. We exclude liability for indirect or consequential losses (loss of profits, data, goodwill). Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

12. Governing law

These Terms are governed by the laws of England & Wales, United Kingdom. The courts of England & Wales, United Kingdom have exclusive jurisdiction over any disputes arising in connection with the Service.
